This week, the U.S. Senate is expected to vote on three Trump administration nominees for key positions at the National Labor Relations Board that are part of larger <a href="https://www.congress.gov/bill/119th-congress/senate-resolution/532" target="_self"><ins>en bloc</ins><ins> package</ins></a> of almost 100 government nominees.

On October 9, the U.S. Senate Committee on Health, Education, Labor and Pensions (HELP), chaired by Sen. Bill Cassidy (R-La.), <a href="https://www.reuters.com/legal/government/us-senate-panel-approves-two-trump-nlrb-nominees-tables-third-2025-10-09/" target="_self"><ins>approved </ins></a>Carey and Murphy. Mayer <a href="https://www.reuters.com/legal/government/us-senate-committee-clears-boeing-lawyers-stalled-nlrb-nomination-2025-12-03/" target="_blank"><ins>was approved </ins></a>by the HELP Committee on December 3.
The NLRB currently has four of its five board seats vacant following President Trump’s firing of Biden appointee Gwynne Wilcox in January of this year and the expiration of NLRB Chair Marvin Kaplin’s term on August 27.
The confirmation of Mayer and Murphy would restore the NLRB’s functionality, as it cannot issue decisions on labor and employment matters in the workplace unless it has a quorum of least three voting members. The NLRB has a backlog of hundreds of cases that cannot be heard without a quorum.
To date, the board currently has only one member, Biden appointee David Prouty, who voted with the NLRB majority of Biden appointees in support of unprecedented and pro-union decisions that are likely to be overturned by a new NLRB. However, a Republican-controlled NLRB cannot reverse these controversial cases without one additional Trump nominee following the confirmation of Murphy and Mayer.
Contact your U.S. Senators today and ask them to confirm Carey, Murphy, and Mayer this week and to confirm one more Republican nominee in early 2026. The NLRB is too important to be dysfunctional; employers and employees across America need NLRB certainty and action.&nbsp;

Urge the U.S. Senate to Confirm President Trump's NLRB Nominees

I am a member of the American Pipeline Contractors Association writing to ask you to confirm National Labor Relations Board nominees James Murphy and Scott Mayer for vacant NLRB seats and Crystal Carey to serve as the NLRB general counsel. This week, the Senate is expected to vote on their nominations as part of a larger en bloc package of almost 100 nominees (S. Res. 532).

The NLRB currently lacks a quorum of three members of the five-seat board, which has created a backlog of hundreds of cases addressing labor and employment issues in the workplace. The NLRB is too important to be hobbled and needs the Senate to confirm an additional NLRB nominee in early 2026 to address controversial cases and recent decisions that have undermined decades of labor law precedence.

On October 9, the U.S. Senate Committee on Health, Education, Labor and Pensions (HELP), chaired by Sen. Bill Cassidy (R-La.), approved Carey and Murphy. Mayer was approved by the HELP Committee on December 3.

Carey, Murphy, and Mayer are all highly qualified nominees, and the Senate’s confirmation of these candidates would restore the NLRB’s functionality and enable it to decide non-controversial cases again.
