Why this annexation should concern you 
The City of Sebastian is seeking to annex approximately 204 acres immediately east of the roughly 2,044-acre Graves Brothers property it annexed in February 2023. That annexation was itself years in the making, survived a successful court challenge by the Pelican Island Audubon Society (which stopped an earlier 1,118-acre attempt in 2019 due to inadequate planning), and was approved 5-0 despite persistent concerns from Indian River County, environmental groups including IRNA and the Clean Water Coalition, and the public.&nbsp;
At the time, Sebastian justified the Graves Bros. annexation in part by referencing its own Comprehensive Plan's "Annexation Reserve Area" (Map 1-14) as a growth management framework — a map that confined annexation to specific boundaries. Within just two years of that approval, IRNA documented Sebastian was already eyeing a 383-acre parcel (the proposed Cresswind development south of 69th Street) that sits outside that same reserve area. This Akbarian-area parcel follows the same pattern: incremental annexations that collectively bypass the planning commitments Sebastian made to justify the last major one.
The property lies adjacent to drainage feeding the headwaters of the St. Sebastian River — one of the most ecologically sensitive water bodies in Indian River County and a critical contributor to Indian River Lagoon water quality.&nbsp;
The area is also outside the County's Urban Service Line, meaning there is no guaranteed pathway to water and sewer service. The county has previously warned that its infrastructure cannot absorb ongoing annexation without significant investment and planning and it would put pressure on existing utility customers, including those in the City of Sebastian. No comprehensive master plan exists for how this parcel integrates with the Graves Bros. development or the broader watershed. Approving this annexation before those questions are answered would repeat the exact mistakes the city was sued over in 2019.
This is not appropriate land to annex for increased density.
Take it from Mayor Fred Jones himself, “We've got to do something to try to slow down this growth,” he told <a href="https://bsoosd.podbean.com/" target="_blank">WTTB radio host Bob Soos</a> on Feb. 12. “Is there something that we can do? We're going to be overloaded if we continue down the same trail that we're on right now.” Let's hope he and Council still agree two months later...&nbsp;

I write to oppose Ordinance O-26-03, the proposed annexation of 204 acres east of the Graves Brothers property, and to urge that the Council table this matter until a clear fiscal analysis has been presented to the public.

Annexation is not free. When the city expands its boundaries, it takes on service obligations — roads, emergency response, stormwater infrastructure, and ultimately utility connections — for everything within those boundaries. Indian River County officials warned repeatedly during the Graves Brothers annexation process that the county could not guarantee water and sewer service to that area under its existing infrastructure. Those warnings have not been fully resolved. Now, before a single shovel has turned on the 2,044-acre Graves Brothers tract, the city is considering adding another 204 acres to its territory.

Nonprofit research organizations like Strong Towns have documented what most people intuitively understand: aggressive annexation can become a long-term fiscal liability for existing residents, who often end up subsidizing infrastructure extensions that serve new development at the urban fringe. Sebastian residents deserve a transparent accounting of what this annexation — and the cumulative growth pattern it represents — will cost them in services, infrastructure, and debt before it is approved.

I urge the Council to vote no on Ordinance O-26-03 and to commission an independent fiscal impact analysis of this parcel and the larger Graves Brothers development trajectory before the city's annexation boundary expands further.

I am writing to respectfully ask you to vote against Ordinance O-26-03, the proposed voluntary annexation of approximately 204 acres located south of 77th Street, east of 74th Avenue, north of 73rd Street, and west of 66th Avenue.

I understand the city has an interest in managing growth at its borders. But I am deeply concerned that this proposal is moving forward without the same public engagement, environmental review, and infrastructure planning that Sebastian said was necessary to justify the Graves Brothers annexation in 2023. Before the city considers adding another 200-plus acres, there are foundational questions that have not been answered: How will this property be served with water and sewer? What is the plan for stormwater that drains toward the St. Sebastian River? How does this fit into any comprehensive growth strategy?

Sebastian's own Comprehensive Plan includes an Annexation Reserve Area that was cited as the framework for responsible growth. That commitment means something to residents who were told the city was planning carefully. Adding parcel after parcel adjacent to the Graves Brothers property — before the infrastructure to serve that land is even in place — is not careful planning. It is a pattern that will ultimately cost city and county taxpayers alike.

I ask that the Council pause, answer these questions publicly, and only move forward when a credible plan is in place.

I am writing to urge the Council to vote against Ordinance O-26-03 at the April 8th hearing.

The 204 acres proposed for annexation lie adjacent to and east of the Graves Brothers property and within the drainage basin of the St. Sebastian River headwaters — an area that flows directly into the Indian River Lagoon. The Lagoon is already under severe stress from nutrient pollution, and the headwaters of the St. Sebastian River are recognized as a critical area requiring protection and restoration, not further urbanization.

When Sebastian first attempted to annex Graves Brothers land in 2019, the Pelican Island Audubon Society successfully sued the city in part because the environmental review was inadequate. When annexation was ultimately approved in 2023, environmental organizations — including the Indian River Neighborhood Association and the Clean Water Coalition — raised persistent concerns about stormwater management, wetland protection, and downstream water quality impacts.

This annexation would add another 204 acres to a development pipeline that has not yet resolved those earlier concerns. No master stormwater plan integrating this parcel with the adjacent Graves Brothers property has been presented. No environmental impact analysis has been conducted. And the property sits outside the County’s Urban Service Line, meaning utility extension plans remain speculative and if expansion occurs, it will fall on the backs of current ratepayers.

Development of land this close to the St. Sebastian River headwaters demands careful, transparent, science-based planning — not incremental annexation that outpaces the city’s capacity to manage its consequences. We urge the Council to vote no and commit to a comprehensive environmental review before any action is taken.

Ordinance O-26-03: Unresolved Environmental Concerns Require Delay

Ordinance O-26-03: Taxpayers Deserve Answers on Costs Before Annexation Proceeds

I formally opposes Ordinance O-26-03 and requests that the Council vote against the proposed voluntary annexation of approximately 204 acres located south of 77th Street, east of 74th Avenue ROW, north of 73rd Street ROW, and west of 66th Avenue ROW.

I have been engaged in Indian River County land use and water quality issues for many years, including during the extended process that led to the February 2023 approval of the Graves Brothers annexation. I raise the following concerns:

1. Inconsistency with the City’s Comprehensive Plan Commitments. During the Graves Brothers annexation process, the city repeatedly cited its Annexation Reserve Area (Comprehensive Plan Map 1-14) as the framework governing responsible growth. The current proposal continues a pattern of annexation that incrementally expands beyond that framework without equivalent planning or public process.

2. Unresolved Infrastructure Deficiencies. The subject property lies outside the County’s Urban Service Line. Indian River County has not committed to extending water or sewer service to this area. The city has not presented a utility service plan that would adequately serve this parcel or its connection to the broader Graves Brothers development.

3. Absence of Integrated Environmental and Stormwater Review. The parcel drains toward the St. Sebastian River headwaters, which flow into the Indian River Lagoon — a water body listed as impaired under state and federal law. No integrated stormwater management plan for this parcel in combination with the adjacent Graves Brothers property has been submitted for public review. Cumulative nutrient and sediment loading from this drainage basin must be evaluated before annexation proceeds.

4. Insufficient Public Process. The notice period for this hearing is minimal relative to the long-term implications of annexation. Residents, the county, and downstream communities deserve a meaningful opportunity to understand and comment on the full development implications before this land is annexed.

We respectfully urge the Council to vote no on Ordinance O-26-03 and to establish clear standards — including infrastructure commitments, environmental review, and a comprehensive plan amendment process — before any further annexation in this area is considered.
