I am writing to request a delay in the implementation of the Advanced Clean Truck (ACT) rule, which went into effect on January 1, 2025. This rule requires manufacturers to sell a certain percentage of electric medium- and heavy-duty (MHD) trucks.
 
Unfortunately, the ACT rule unintentionally prevents the introduction of new, cleaner trucks on our roads today. The technology for electric MHD trucks has not kept pace with the initiative, and we cannot ignore this fact.
 
Specifically:
 
- Massachusetts lacks the charging infrastructure to support electric MHD trucks.

- Even if the infrastructure were ready, the cost of electric MHD trucks is too high, and their capabilities are not yet sufficient for our industry.

- Any upcoming ACT amendments will not provide the relief we need.

- Implementing the ACT rule is keeping older, dirtier MHD trucks on the road.

- Note that the recent delay in the HDO rule does not address this issue. Delaying HDO mandates does nothing to alleviate this crisis situation.
 
As of December 1 last year, over 1000 new cleaner, safer trucks were already on order. As of the same date this year, there are fewer than 10 MHD trucks on order for 2025.
 
Without a delay in the implementation of the ACT rule, both the private and public sectors will continue to be adversely impacted. While we appreciate the delay in the heavy-duty omnibus rule, it will not help the industry if the ACT rule is not delayed.

Accordingly, I respectfully request that you delay the ACT rule ASAP.
