Big Tech is trying to force AI preemption into the National Defense Authorization Act (NDAA). Preemption means that the federal government would “preempt” all state laws on AI; in other words, if this goes through, states would be banned from regulating AI. Given the lack of federal AI regulation, this would be a catastrophe. 
Congress tried something similar this summer, when they attached a preemption clause to the budget bill. But it failed in the Senate by a 99-1 vote, thanks to public outcry. Big Tech knows how unpopular this is, which is why they’re trying to sneak it in at the last minute – and we won’t let them. 
We need to make sure Congress drops this insane provision.

Fight Big Tech lobbying - oppose AI preemption in the NDAA

I’m writing as a constituent to urge you to oppose the clause on AI preemption that Big Tech is trying to sneak into the NDAA. This clause serves one purpose: to eliminate states’ efforts to protect their citizens from the emerging challenges posed by AI.

This is deeply concerning to me, as thousands of leading scientists warn that out-of-control AI development could threaten us all. AI systems have already gotten good at building weapons and planning cyberattacks, and leading experts warn AI could cause mass harm in the next few years. Rather than address these dangers, this provision would make AI security even more challenging, hinder states’ ability to protect their citizens from AI threats, and risk federal inaction.

States’ continuing efforts to refine their approaches toward AI will serve as an important foundation for eventual federal legislation. For that reason, AI preemption has been opposed by bipartisan groups of state attorneys general and state legislators.

Please speak out against this provision and fight to have it removed from the NDAA immediately. Thank you very much for your time and consideration.
