As a Virginia retailer and business owner, I am writing to you today to urge you to oppose efforts by some members of your party to take some of the most damaging provisions of the Protecting the Right to Organize Act (PRO Act) and inserting them into the budget reconciliation bill in an attempt to pass them without needing bipartisan support.

Specifically, I am talking about the egregious fines that would be levied against businesses—and even personally against small-business owners—in Virginia and throughout the country for even the most minor, technical unfair labor practices (ULPs). If passed, these penalties could threaten businesses across the Commonwealth at a time when many have already endured grave economic hardships resulting from the pandemic.

These fines include penalties up to $50,000 for each ULP, no matter how minor or frivolous. We aren’t talking about employers firing or taking punitive action against union supporters; these fines could be applied for even the smallest infractions, including hanging a poster in the wrong place.

Given the complexity of federal labor laws, these increased penalties will expose Virginia employers to excessive penalties that could put them out of business for violations they didn’t even know they were making. Obviously, these fines also give union leaders more leverage over local businesses, enabling them to use the mere threat of reporting ULPs in order to gain the upper hand during organizing efforts.

I greatly appreciate you standing with Virginia’s retailers and opposing the PRO Act, and I hope that you will stand with us again on this provision. Please consider the impact these excessive ULP fines will have on Virginia retailers, small businesses, and our entire economy and oppose the efforts to include this provision in the budget reconciliation bill.
