Action Alert: Co-Sponsors needed to change the Pennsylvania Mechanics Lien Law

Early last year the Pennsylvania Superior Court ruled against a Pennsylvania construction equipment rental company in a precedent-setting case with serious implications for all construction equipment rental businesses. The court interpreted Pennsylvania's Mechanics' Lien Law, which is designed to ensure that contractors, material suppliers, and equipment providers on construction sites receive payment – as excluding rental equipment. As a result, the rental company in this case lost over $200,000 in unpaid rent and damaged equipment. 

The American Rental Association (ARA) is advocating for an amendment to Pennsylvania’s Mechanics Lien Law to explicitly include rental equipment. The bill’s prime sponsors, Representatives Pat Harkins and Bob Merski, need your support. Your state representative is currently a member of the Pennsylvania House Judiciary Committee and/or the Pennsylvania House Labor and Industry Committee. 

We urge you to contact your state representative and encourage them to sign on as a co-sponsor of this critical legislation. This is a critical first step in securing broad legislative support. Since we anticipate opposition, your involvement is essential. Please take action today.
