AB 1248 has recently been amended but it remains a very dangerous bill for rental housing providers.

  • Housing providers will be faced with the impossible task of including in an advertisement, display, or rental offer, the price including all required fees or charges, and a description of all available optional housing services and the associated fees.  
  • It would severely regulate and limit the use of Ratio Utility Billing (RUBs) and not allow for fees associated with third-party billing. RUBs could only be used for water and sewer. Prospective tenants must also be given copies of previous bills that estimate what they might pay for the utilities. 
  • Defines Housing Services as all services related or connected to the use, occupancy, or enjoyment of residential real property, or that are required to be provided by law or are a condition of tenancy in the residential real property, including, but not limited to, trash collection, electrical service, water service, sewer service, gas service, other utilities, elevator service, storage, parking, facilities, access to common areas, repairs, maintenance, heat, hot water, pest control, security, or any other benefits, privileges, or services, whether express or implied.  
  • Optional and required fees would be factored into the gross rental rate allowed under state law.
  • A decrease in housing services would be an increase in the gross rental rate. 
  • These are just some of the major problems with AB 1248.
