Members: We need your help! MAJ’s Priority Legislation seeking to ban exculpatory clauses in waivers to participate in commercial recreational activities is UNDER ATTACK.

As an active Marylander, my family and I participate in many recreational activities. We are tired of being forced to sign waivers that exonerate these facilities from all liability – including their own negligence. 
 
Recreational facilities should not be treated differently than other Maryland businesses. They should not be allowed to get away with negligence by forcing customers to sign waivers of liability. Waivers of liability disincentivize facilities from acting safely. They fail to protect consumers, who are often unaware of latent dangers (like poorly maintained equipment).

If a consumer is injured because of negligence, they should have the right to pursue a claim in court, regardless of whether they signed a waiver to participate.
