Democratic Party lawmakers in Congress—along with a handful of pro-union Republicans—are attempting to appease powerful union special interests and at the expense of merit shop contractors and workers.
We need your help defeating the Faster Labor Contracts Act (FLCA), a key component of the controversial Protecting the Right to Organize Act (PRO Act) and one of organized labor’s top legislative priorities. 
Unfortunately, the FLCA <a href="https://www.congress.gov/votes/house/119-2/216" target="_blank">passed the United States House of Representatives on June 9 on a bipartisan basis</a>, despite <a href="https://www.pccaweb.org/ga/pcca-letter-to-u-s-house-opposing-faster-labor-contracts-act-h-r-5408" target="_blank">PCCA </a> and <a href="https://ieci.org/merit-shop-coalition-fights-fast-tracked-faster-labor-contract-act/" target="_blank">coalition</a> lobbying and grassroots efforts.  
Now we need your grassroots advocacy to defeat the FLCA in the U.S. Senate and prevent it from going to President Trump’s desk for his signature. 
FLCA Is Bad Public Policy As illustrated in this coalition <a href="https://myprivateballot.com/wp-content/uploads/2026/06/CDW_FLCA-Opposition-Letter_June-2026_v2.pdf" target="_blank">letter</a>, <a href="https://myprivateballot.com/wp-content/uploads/2026/06/CDW_FLCA-White-Paper_The-Arbitration-Trap_June-2026.pdf" target="_blank">white paper</a>, <a href="https://myprivateballot.com/wp-content/uploads/2026/06/FLCA-Fact-Sheet-June-2026.pdf" target="_blank">fact sheet</a>, <a href="https://myprivateballot.com/wp-content/uploads/2026/06/Complete-List_Op-eds_2025-2026.pdf" target="_blank">media coverage</a>, and other <a href="https://myprivateballot.com/wp-content/uploads/2026/06/FLCA-Myth-v-Fact-Rebuttal_June-2026.docx.pdf" target="_blank">resources</a>, the FLCA is bad public policy. The FLCA is specifically problematic for PCCA contractors and workers because after a union organizing campaign that results in the certification of a union:  
<ul>
<li style="margin-left:0px;">Employers would have to begin bargaining with a newly certified union within 10 days of the union submitting a written request, and the parties would have 90 days to reach a first contract.</li>
<li style="margin-left:0px;">If no agreement is reached, either party could invoke mediation through the Federal Mediation and Conciliation Service, an obscure agency the Trump administration has targeted for near elimination.  </li>
<li style="margin-left:0px;">If no agreement is reached after 30 days of mediation, binding interest arbitration is triggered, and the resulting contract is binding for two years.  </li>
<li style="margin-left:0px;">These arbitrators would have the power to set wages, benefits, and working conditions—without regard for a company’s financial reality.</li>
<li style="margin-left:0px;">Neither party may appeal it, and workers do not get to ratify or reject it. </li>
</ul>
For small, merit shop contractors, this could mean:  
<ul>
<li style="margin-left:0px;">Unsustainable labor costs. </li>
<li style="margin-left:0px;">Reduced flexibility to manage your workforce. </li>
<li style="margin-left:0px;">Increased legal and administrative burdens. </li>
<li style="margin-left:0px;">Less control over your business operations. </li>
</ul>
Legislative Background On March 26, 2026, IBEW member Rep. Donald Norcross (D-N.J.) introduced a House resolution (H.Res. 1140) and <a href="https://clerk.house.gov/DischargePetition/2026042019" target="_blank">filed a discharge petition</a> on April 20 to force a House vote on the PCCA-opposed Faster Labor Contracts Act (<a href="https://www.congress.gov/bill/119th-congress/house-bill/5408" target="_blank">H.R. 5408</a>). 
On May 20, that discharge petition reached the required 218 signatures,<a href="https://clerk.house.gov/DischargePetition/2026042019" target="_blank"> including seven Republicans</a>, which forced the FLCA to bypass committee review and proceed to a House floor vote. 
On June 9, 2026, the FLCA passed by a vote of 230-193, with 20 Republicans voting with almost all Democrats in support of the FLCA.
The 20 GOP House members <a href="https://www.congress.gov/votes/house/119-2/216" target="_blank">who voted for the FLCA</a> are Don Bacon* (NE), Robert Bresnahan* (PA), Mike Carey (OH), Brian Fitzpatrick* (PA), Andew Garbarino (NY), Carlos Gimenez (FL), David Joyce (OH), Nick LaLota* (NY), Nick Langworthy (NY), Mike Lawler* (NY), Nicole Malliotakis (NY), Max Miller* (OH), Riley Moore* (WV), Michael Rulli (OH), Maria Salazar (FL), Chris Smith (NJ), Pete Stauber (MN), Michael Turner (OH), Jeff Van Drew (NJ), and Derrick Van Orden (WI). 
Of note, all but one of the <a href="https://www.congress.gov/bill/119th-congress/house-bill/5408/cosponsors?q=%7B%22party%22%3A%22Republican%22%7D" target="_blank">17 Republican cosponsors of the FLCA</a> voted for the bill and Republicans with an * next to their names signed the discharge petition. 
Fight the FLCA in the U.S. Senate Now the FLCA is before the <a href="https://www.help.senate.gov/about/members" target="_blank">U.S. Senate Health, Labor, Education, and Pensions Committee</a> chaired by Sen. Bill Cassidy (R-LA) and ranking member Bernie Sanders (I-VT).  
Unfortunately, the bill is likely to advance out of committee, and the Senate HELP may be forced to vote on the bill as early as June 24.
Republican HELP committee member Sen. Josh Hawley (R-MO) introduced the Senate version of the FLCA (<a href="https://www.congress.gov/bill/119th-congress/senate-bill/844" target="_blank">S. 844</a>), and HELP committee member Sen. Roger Marshall (R-KS) is a cosponsor along with 14 Democrats and Republican Sen. Bernie Moreno (OH). 
Possible June 24 HELP committee votes on nominees to fill vacant National Labor Relations Board seats may allow Sens. Hawley and Marshall to advance the FLCA out of committee along with the support of all committee Democrats. 
The FLCA will likely need 60 votes to pass the Senate and head to President Trump’s desk for a signature. However, the White House has not publicly indicated its position on the FLCA.

Tell the U.S. Senate to Oppose the Faster Labor Contracts Act

I urge you to oppose the controversial Faster Labor Contracts Act (H.R. 5408/S.844).

This FLCA represents a significant and troubling shift in federal labor policy. By imposing binding interest arbitration, it would allow government-appointed arbitrators to dictate the terms of private-sector labor agreements, undermining the long-standing principle of voluntary negotiations between employers and employees.

As your constituent, I am particularly concerned about the impact on small businesses. Many employers—especially in the pipeline contracting and construction industry—operate on tight margins and face unique workforce challenges. This legislation ignores those realities and could force businesses into agreements they cannot afford to sustain.

Additionally, the bill weakens worker choice by allowing contracts to be imposed without employee ratification.

At a time when our economy depends on flexibility, growth, and job creation, this proposal moves us in the wrong direction by increasing federal control over workplace decisions.
